The Residential Tenancies Board (RTB) has ordered the Independent Trustee Company (ITC), acting as trustee of an unnamed Irish pension fund, to pay a tenant €12,500 in compensation for wrongful eviction.
ITC acts as the trustee of the pension fund that owns the property, but responsibility for its management rests with the appointed property manager.
According to a determination order published by the RTB, ITC must pay the amount to the tenant, Grzegorz Karol Hreniak, “in respect of compensation for illegal eviction”.
The case related to a property on Waterfall Avenue in Drumcondra, Dublin.
The RTB stated that the compensation agreement had been reached between the parties and ordered the sum to be paid within 21 days of the determination, made on 10 September 2025.
ITC describes itself as one of Ireland’s largest providers of self-administered pensions, administering more than €2.5bn of client funds across over 6,000 pension structures.
Land Registry records show the company is also the registered owner of more than 2,000 properties nationwide.
However, the firm has been involved in several tenancy disputes published by the RTB in recent years, mainly concerning rent arrears.
In one case earlier this year, a tenant renting an apartment on Abbey Street in Co. Cork was ordered to pay ITC rent arrears of €6,129.
In that case, the RTB heard that the tenant, Robert Hourihane, had been paying €562 per month while sharing the property, before taking on the full rent with Housing Assistance Payment support when the other tenant moved out.
The arrears owed to the end of February 2025 were stated to be €7,013, and the RTB concluded that the landlord’s notice of termination, issued in September 2024, was valid, ordering the tenant to vacate the property within 28 days.
Following a request for comment regarding the latest determination, the ITC provided this statement: “The property is owned by a pension fund and ITC is the trustee of that pension fund.
"Responsibility for day-to-day property management, including compliance with rental regulations and liaison with tenants or licensees, rests with the appointed property manager.
"ITC’s role as trustee is to hold the property within the pension structure for the benefit of the scheme member/s and to ensure that a regulated property manager is appointed.
"ITC, as trustee, does not directly manage properties or tenant arrangements.”
