Swedish court gives FTN until 20 May to respond to Indecap, as dispute continues

The Administrative Court in Stockholm has granted the Swedish Fund Selection Agency (FTN) an extension until 20 May 2026 to respond to new arguments submitted by Indecap Fonder AB in the ongoing legal challenge over FTN’s procurement of actively managed global equity funds.

The case concerns FTN’s SEK 200bn procurement for Sweden’s premium pension system, the agency’s largest procurement to date. The tender, announced on 26 February 2026, has been paused due to the judicial review after Indecap Fonder lost out in the selection process.

The latest development follows Indecap Fonder’s submission of additional legal arguments to the Administrative Court. In April, the court extended Indecap’s deadline from 8 April to 17 April 2026 to allow the firm to submit a statement in response to FTN’s opposition to the judicial review application.

After receiving Indecap Fonder’s statement, which expanded its legal arguments and invoked additional grounds in support of its claims, the court granted FTN additional time to prepare its response.

Once FTN submits its reply, the Administrative Court will determine the next steps in the case.

The court’s review is focused on whether FTN conducted the procurement in accordance with the rules governing Sweden’s premium pension fund platform.

No timetable has yet been set for when a judgment may be delivered.
